1. General Information
Marlborough Surf Fishing Club (“MarlboroughSFC,” “we,” “us,” or “our”) offers merchandise featuring original designs and artwork through independent third-party retail and fulfillment services.
These Merchandise Terms and Conditions apply to merchandise promoted through MarlboroughSFC.com and sold through our associated Etsy shop.
Our merchandise may include clothing, accessories, drinkware, and other products featuring original MarlboroughSFC designs.
Purchases are completed through Etsy and are also subject to Etsy’s applicable terms, policies, and buyer protections.
These Merchandise Terms and Conditions are separate from the general Terms of Use governing MarlboroughSFC.com.
2. Merchandise Production and Fulfillment
MarlboroughSFC merchandise is produced and fulfilled by independent third-party print-on-demand suppliers.
We do not manufacture, warehouse, package, or directly ship merchandise.
Products are generally manufactured after an order is placed and shipped directly to the customer by our production partners.
Customers acknowledge that:
- Merchandise is produced specifically to fulfill individual orders.
- Production and shipping times may vary.
- Orders containing multiple products may arrive in separate shipments.
- Product packaging may identify a third-party manufacturer or fulfillment provider.
- Minor variations in printing, positioning, and color may occur because of differences in production processes and materials.
We make reasonable efforts to ensure that product descriptions and representations accurately reflect the merchandise offered for sale.
3. All Sales Final — Returns and Exchanges
ALL SALES ARE FINAL.
Because MarlboroughSFC merchandise is produced on demand, we do not accept voluntary returns or exchanges.
Returns, exchanges, or refunds are not offered for:
- Changes of mind after placing an order.
- Incorrect sizes, colors, or product selections made by the customer.
- Ordering the wrong product or quantity.
- Personal dissatisfaction with merchandise that conforms to its description and is not defective.
- Merchandise that is no longer wanted or needed.
Customers are responsible for carefully reviewing product descriptions, sizing charts, colors, quantities, and other information before completing their purchases.
Exceptions: This final-sale policy does not eliminate remedies available for damaged, defective, incorrect, or undelivered merchandise under Etsy’s applicable policies or consumer protection laws.
4. Damaged, Defective, or Incorrect Merchandise
MarlboroughSFC merchandise is manufactured and shipped by independent third-party production partners.
Our production partners are responsible under their agreements with us for addressing manufacturing defects, printing errors, and damage occurring during production or fulfillment.
If merchandise arrives damaged, defective, or materially different from the product ordered, customers should contact us through Etsy.
Customers should provide their order number, a description of the problem, and photographs when available.
MarlboroughSFC will coordinate with the applicable production partner to investigate and resolve the issue.
Depending on the circumstances, appropriate remedies may include replacement merchandise, refunds, or other resolutions required by Etsy’s policies or applicable law.
MarlboroughSFC remains responsible for its obligations as the Etsy seller, regardless of the production partner used.
5. Shipping and Delivery
Merchandise is shipped directly from third-party production facilities.
Estimated production and delivery times are provided through Etsy and may vary depending on the product, production partner, shipping destination, and carrier.
Shipping estimates are not guaranteed delivery dates unless expressly identified as such.
Customers are responsible for providing accurate shipping information when placing orders.
Orders that cannot be fulfilled or shipped within the applicable timeframe will be handled according to Etsy’s policies and applicable law.
6. Order Cancellations
Because merchandise is produced on demand, production may begin shortly after an order is submitted.
Order cancellations cannot be guaranteed once production has started.
Customers requesting cancellation should contact MarlboroughSFC through Etsy as soon as possible.
Cancellation requests will be evaluated based on production status, applicable Etsy policies, and legal requirements.
If an order is canceled before fulfillment and payment has been collected, an appropriate refund will be issued.
7. Product Descriptions and Color Variations
We make reasonable efforts to accurately represent merchandise through product photographs, illustrations, descriptions, and sizing information.
However, colors may appear differently depending on computer monitors, mobile devices, display settings, and manufacturing processes.
Minor differences between digital product representations and finished merchandise may occur.
These normal manufacturing variations do not automatically constitute product defects.
This provision does not apply to merchandise that is materially different from its description or otherwise fails to meet applicable consumer protection requirements.
8. Intellectual Property and Original Designs
All original artwork, illustrations, graphics, logos, and merchandise designs created for MarlboroughSFC remain the intellectual property of Marlborough Surf Fishing Club or their respective rights holders.
The purchase of merchandise does not transfer ownership of the underlying artwork or designs.
Customers may not reproduce, distribute, modify, or commercially exploit MarlboroughSFC designs without prior written authorization.
Unauthorized commercial reproduction or distribution may violate applicable copyright, trademark, or other intellectual property laws.
9. Third-Party Sales Platform
MarlboroughSFC merchandise is sold through Etsy, an independent third-party e-commerce platform.
All purchases are processed through Etsy’s checkout system.
Customers purchasing merchandise are subject to Etsy’s applicable Terms of Use, payment policies, and Purchase Protection policies.
MarlboroughSFC does not independently process payments for purchases completed through Etsy.
In the event of a conflict between these Merchandise Terms and Conditions and mandatory Etsy policies or applicable consumer protection laws, those policies and laws will control.
10. Product Safety and Care
Customers should follow all applicable manufacturer care instructions, washing recommendations, and product safety warnings.
MarlboroughSFC is not responsible for damage resulting from improper washing, handling, storage, or use of merchandise, except where liability cannot legally be excluded.
11. Limitation of Liability
To the extent permitted by applicable law, MarlboroughSFC shall not be liable for indirect, incidental, special, or consequential damages arising from the purchase or use of merchandise.
Nothing in these Merchandise Terms and Conditions excludes or limits liability that cannot legally be excluded, including applicable consumer protection rights.
12. Changes to Merchandise Terms and Conditions
MarlboroughSFC reserves the right to update these Merchandise Terms and Conditions.
Changes will become effective when published on MarlboroughSFC.com unless otherwise specified.
Changes will not retroactively alter the terms applicable to completed purchases where prohibited by law.
